Abstract

In Islamic Law, a child who lost his father is commonly called an orphan. This qualification lasts until the age of puberty. The main difference between the inheritance law and the other statutory provisions is that the concept is originated from verses, hadiths and what has been agreed upon by scholars (İjma). In the Qur'an, the provisions related to inheritance are mentioned in the surahs of Nisâ, Enfâl and Ahzâb. In this research, our priority is to examine the provisions on the inheritance of the orphans and to evaluate how the rights and narratives should be reconsidered. The concept of Orphan from the linguistic and idiomatic perspectives and how the orphan child is protected will be explain. We will also clarify the controversies surrounding the inheritance rates between girls and boys, and the situation of the orphan children before Islam and how the justice of Allah is just.
