Abstract

Until recently, it has been unthinkable that the state might be constitutionally obliged to place limits upon human use of their animal property for reasons independent of the rights or interests of another human person. Yet, a number of diverse jurisdictions have now adopted constitutional provisions committing the state to protect the interests of animals. However, there is no direct provision in our Constitution regarding the protection and welfare of animals. Increasing animal rights violations in our country especially in recent years, have brought up the idea of revision of the legislation related to animals and ensuring constitutional guarantee of animal rights. In this study, the legal arrangements related to the protection of the animals in both international comparative law and domestic law are examined, and certain suggestions regarding legislative changes that could better serve the protection and welfare of animals are tried to be made by discussing whether the existing legislation related to animals in our country meet the social expectations or not in the light of opinions and criticisms in the doctrine.
