Abstract

This study aims to examine main arguments of philosophy of Enlightenment and the effects of these concepts on criminal justice system and its applications. It can be said that the philosophy of modern criminal law is the reflection of Enlightenment philosophy and its perception of modern subject. After try to analyze essential concepts of Enlightenment philosophy and its relation to modern subject the study examines the philosophy of criminal justice system. Classical School of Criminal Law underlines the fact that crime is a result of rational choice. Therefore, Classical School of Criminal Law thinkers believe that laws should be concrete, deterrent and well defined. Lastly, the study strives to scrutinize critics of basic concepts of Classical School of Criminal Law and give suggestions characteristics of laws to secure the justice.
