Abstract

The removal of the penalty by statute of limitations in the context of the Turkish Penal Code in terms of the suspension or cancellation of the implementation of this clause is reflected in two forms. Where the reasons that suspend the enforcement of the statute of limitations have not been provided in the Turkish Penal Code (Turkish Criminal Code). There are, however, special legal provisions that cancel the issue of removal of the penalty by statute of limitations. The reasons such as winning the deputyship, being convict during military service, being sentenced under an another judgment, the delay or suspension of the execution of the sentence are all reasons for the suspension of the penalty by statute of limitations. Since the reason for the cessation of the criminal time limit is present, the statute of limitations will not be effective. The notification of the convicted person is subject to the provisions of the Turkish Criminal Code; for example, arresting of a convicted person for the execution of a conviction and a deliberate offense for more than two years of imprisonment are factors that nullify the effect of the statute of limitations.
