Abstract

Mediation refers to the process by which the parties to the dispute are brought together by a common person or mediator or arbitrator, in a common or common denominator. In this study, it is aimed to evaluate the concept of mediation in the context of merit and specialization. In this study, literature sources and document scanning model were used. In the research, descriptive scanning model and content analysis methods and mediation were examined. According to the results obtained in the study, trust and impartiality are the most important requirements in mediation processes, as in all legal processes. On the other hand, while mediation processes lacking merit in a short term, they can make the problems in the middle term more chronic and grave in the long run. For the most effective and successful fulfillment of the public interest from the mediation process, the main objective should be not only to resolve non-compromise issues temporarily, but to produce permanent solutions. For this purpose, there are big assignments for public administrators and individuals and institutions considering to provide mediation services if necessary.
